Family Locator — Terms of Use

TERMS OF USE

1. ACCEPTANCE

These Terms of Use ("Terms") form a binding agreement between you and BILLIONX LABS LIMITED ("we," "us," or "our") governing your use of the Family Locator — GPS Tracker mobile application and related services (the "Services"). By downloading, installing or using the Services you accept these Terms. If you do not accept them, do not use the Services.

2. THE SERVICE

Family Locator lets you share your device location with people you explicitly approve, and to view the location of people who have explicitly approved you. Connections are created through single-use invitation codes, typed manually or shown/scanned as a QR code. The Services also provide optional saved places with arrival and departure alerts sent to the people you choose for each place, location history (visible to an approved viewer only from the time their access began), an SOS alert that notifies the people in your circle, and a "find my phone" feature that rings a paired device at full volume so it can be found.

Sharing your own location is an explicit session you start and can stop at any time; it is never blocked by subscription status. If your phone restarts, the App updates, or the operating system stops the App, that sharing session pauses and does not resume automatically — you must reopen the App to resume it.

You may only share a device's location with the informed consent of the person who uses that device. You may only view another person's location, receive their SOS alerts, or ring their device where that person has granted you access through the App.

You must not use the Services to monitor, stalk, harass or track any person without their knowledge and consent, or in any way that violates applicable law, including laws on privacy, surveillance, stalking and employment. If you set up the App for a minor in your care, you are responsible for obtaining any consent required by local law and for informing them that their location is shared.

We may suspend or terminate accounts that we reasonably believe are being used in violation of this section.

4. ACCOUNTS

You are responsible for the accuracy of the phone number and name you provide and for the activity on your device. Do not impersonate another person or provide a phone number you are not authorised to use. Keep your device secured, since access to your unlocked device grants access to your account.

5. SOS AND EMERGENCY DISCLAIMER

The SOS feature sends an in-app alert, with your last known position where available, to the people who are already approved to see your location. The SOS feature does not contact the police, fire, ambulance or any other emergency service, and no alert is monitored by us or by any response centre. Delivery depends on the recipients' devices being connected and the App being able to reach them; we do not guarantee that any SOS alert will be delivered or seen in time, or at all. In a real emergency, always contact your local emergency services directly.

You must not trigger SOS alerts frivolously or to harass the members of your circle. The "find my phone" ring feature must only be used to locate a device you own or a device whose user has approved you; deliberately ringing another person's device to disturb them is a breach of these Terms.

6. SUBSCRIPTIONS AND PAYMENT

Certain features require a paid subscription, including sending an SOS alert, finding a lost phone by making it ring, viewing another person's live location or history, creating a saved place, and sending an invitation (by 6-digit code or QR code). Subscriptions are sold and processed through Google Play, and your purchase is also subject to Google Play's terms. You can cancel at any time in Google Play > Subscriptions. Sharing your own location, accepting an invitation someone else sent you, and stopping your own sharing never require a subscription.

Auto-renewal: Subscriptions renew automatically at the end of each billing period (weekly, monthly, or yearly, depending on the plan you selected) at the price shown at purchase, until you cancel.

Cancellation: Cancel at any time in Google Play > Subscriptions, at least 24 hours before the end of the current period to avoid the next charge. Cancelling stops future renewals; access continues until the end of the paid period.

Trials and introductory offers: Where an introductory or trial price is offered, it applies only to eligible accounts as determined by Google Play, and the subscription converts to the standard price at the end of the introductory period unless cancelled at least 24 hours beforehand.

Refunds: Refunds are handled by Google Play under its refund policy. Except where required by applicable law, payments are non-refundable.

Price changes: We may change subscription prices. Changes apply to subsequent billing periods, and Google Play will notify you and obtain any consent required before a changed price takes effect.

Entitlement accuracy: We validate purchases with Google Play and receive Google Play's notifications of renewals, cancellations, refunds and revocations. If Google Play reports that a purchase is refunded or revoked, the corresponding premium access ends.

7. ACCEPTABLE USE

You must not: reverse engineer, decompile or tamper with the App except to the extent permitted by applicable law; access the Services by automated means or attempt to circumvent rate limits, authentication or authorization; attempt to obtain location data for, send ring requests to, or read the alerts of any person who has not granted you access; interfere with or disrupt the Services; or use the Services to violate the rights of any person.

8. ACCURACY AND AVAILABILITY DISCLAIMER

Location data depends on GPS, network conditions, device settings, battery state and operating system behaviour, and may be delayed, imprecise, incomplete or unavailable. Positions measured while your phone is offline may appear in the App later, once the connection returns. Android may restrict background activity to save power, which can interrupt updates. The App does not request Android's "Allow all the time" background location permission; as a result, a device restart, an app update, or the operating system force-stopping the App will pause sharing until you reopen the App, and we do not guarantee continuous, 24/7, or uninterrupted background operation on every device or OEM. Saved-place arrival/departure alerts and other push notifications are delivered on a best-effort basis and may be delayed or, rarely, not delivered at all. The "find my phone" ring only works while the target device is powered on, connected, and able to receive the request; a ring request expires after a short period if it cannot be delivered.

The Services are not an emergency, safety-critical, medical or security service and must not be relied upon as one. In an emergency, contact your local emergency services. We do not guarantee that the Services will be uninterrupted, error-free, or that any particular location, alert or ring will be delivered at any particular time. We do not claim GPS-precise accuracy at all times or in all conditions.

9. WARRANTY DISCLAIMER

To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, whether express, implied or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for loss of profits, data, goodwill, or for any harm arising from reliance on location data, on an SOS alert, or on the "find my phone" feature, or from the unavailability or inaccuracy of the Services. Our aggregate liability arising out of or relating to the Services will not exceed the greater of the amounts you paid us in the twelve months before the event giving rise to the claim, or USD 50. Nothing in these Terms excludes liability that cannot be excluded under applicable law, including consumer rights that cannot be waived.

11. INDEMNITY

You agree to indemnify and hold us harmless from claims, damages and expenses (including reasonable legal fees) arising from your misuse of the Services or your breach of these Terms or of applicable law, including any claim by a person whose location was shared, whose device was rung, or who received alerts without their consent through your account.

12. INTELLECTUAL PROPERTY

The App, its content and its trademarks are owned by us or our licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App for its intended purpose, subject to these Terms.

13. TERMINATION

You may stop using the Services and delete your account at any time from the App's Profile screen. We may suspend or terminate your access if you breach these Terms, if required by law, or if providing the Services to you becomes commercially or technically unviable. Sections that by their nature should survive termination will survive.

14. CHANGES TO THESE TERMS

We may update these Terms. The "Last Updated" date reflects the latest revision. Continued use after changes take effect constitutes acceptance. Material changes will be notified in the App or by other reasonable means.

15. GOVERNING LAW

These Terms are governed by the laws of the jurisdiction in which BILLIONX LABS LIMITED is established, without regard to conflict of law rules, and without depriving you of the protection of mandatory consumer law in your country of residence.
